The NYS Electronic Equipment Recycling and Reuse Act (PDF) (39 kb) (Article 27, Title 26 of the Environmental Conservation Law) was signed into law by the Governor on May 28, 2010. The law will ensure that every New Yorker will have the opportunity to recycle their electronic waste in an environmentally responsible manner. The law requires manufacturers to establish a convenient system for the collection, handling, and recycling or reuse of electronic waste. Manufacturers of covered electronic equipment (CEE) will be responsible for implementing and maintaining an acceptance program for the discarded electronic waste, with oversight by the NYS Department of Environmental Conservation (Department).

- 5/13/2011 - The list of New York State Registered Covered Electronic Equipment Manufacturers and their Brand(s) (PDF) (89 kb) has been updated. The list contains the registered manufacturer's name, its Department-issued registration number, a listing of the manufacturer's registered brand name(s), and the manufacturer's toll-free telephone number and public education website where a consumer can find out how to free and conveniently recycle his or her covered electronic equipment. This list will be updated regularly. If a link does not work when you click on it, please copy and paste it into your browser.
- 5/10/2011 - Acceptance standards are being calculated and will be mailed by the Department to manufacturers no later than June 1, 2011. This information will not be posted on the website at this time.
Who will be affected by the law?
If you are a consumer, retailer, or manufacturer of the covered electronic equipment listed below; an electronic waste recycling facility, electronic waste consolidation facility, or electronic waste collection site; or a solid or hazardous waste management facility, you will be affected by the NYS Electronic Equipment Recycling and Reuse Act.
Which types of electronic waste will manufacturers be required to accept for recycling and reuse?
Beginning April 1, 2011, manufacturers of covered electronic equipment will be required to accept the following:
- Computers
- Televisions (as well as cathode ray tubes)
- Small Scale Servers
- Computer Peripherals
- Monitors
- Electronic Keyboards
- Electronic Mice or Similar Pointing Devices
- Facsimile Machines
- Document Scanners
- Printers
- Small Electronic Equipment
- VCRs
- Digital Video Recorders
- Portable Digital Music Players
- DVD Players
- Digital Converter Boxes
- Cable or Satellite Receivers
- Electronic or Video Game Consoles
1: Computer peripherals and small electronic equipment also include any cable, cord, or wiring permanently affixed to or incorporated into such product.
2: Only those intended for use with a computer and weighing less than 100 lbs.
What is the Department's role under the law?
The Department is responsible for overseeing a comprehensive system for managing the rapidly growing problem of electronic waste across the state. The Department must collect, process, analyze, track and summarize information required by the Act. The law will require the Department to use this data to allocate responsibility for the collection of electronic waste amongst manufacturers of CEE. In addition, the Department must maintain and post on its website a list of registered manufacturers and collective electronic waste acceptance programs, links to their programs' public education program webpages, and all forms necessary for the regulated community to comply with the Act. The Department is also required to submit a report to the governor and legislature biennially which evaluates the electronic waste stream in the state; evaluates the recycling and reuse rate in the state for CEE; discusses compliance; recommends any changes to the title; and discusses opportunities for business development in the state related to this title.
